Outline of New GOJ Privacy Framework

Delivered at the Asian Privacy Scholars Network’s 4th International Conference at Meiji University, this slide deck for KICIS Director Jim Foster’s presentation highlights the new GOJ Privacy Framework as it undergoes revision in 2014. Significant changes include the establishment of a “third party authority” that will exist to enforce regulations and private voluntary codes, as well as a acknowledgement by the Japanese government of the multistakeholder community in setting rules for privacy.

Significant discussion of the business community reaction to the proposed changes to the law is covered, including strong support for the promotion of “de-identified” personal data for innovation purposes, as well as support for a “dynamic” approach to protecting privacy. Concern over adequate funding of a new oversight agency and the framework of cooperation between the oversight body and the new Cybersecurity Center remain significant points to overcome.

ACCJ Viewpoint: GOJ Policy Review on the Protection and Utilization of Personal Data

The American Chamber of Commerce in Japan (ACCJ) released their viewpoint on the GOJ Policy Review on the Protection and Utilization of Personal Data on July 18, 2014. The viewpoint examines the promotion of utilization of personal data for commercial purposes while adopting a dynamic approach to protection with the participation of the multistakeholder community.

Additionally, the viewpoint  calls for clarification of data disclosure procedures and the minimization of restrictions on cross-border data flows. Ensuring that due process is followed and seeking constructive solutions to data breaches will be facilitated by avoiding conflicting legal frameworks and the direct facilitation of obtaining consumer consent for the repurpose of data usage.
